Terms:

There will be a finance charge of 2% per month (24% per annum) on all accounts past 30 Days. All accounts without prior approval, which have outstanding balances over 90 days will be temporarily placed on C.O.D. The account will remain on C.O.D. basis until balance is paid or suitable arrangements are made with credit department. I certify that I am an authorized agent with the authority to enter into this agreement on behalf of my company.

Personal Guaranty

The undersigned, individually, as well as on behalf of the Buyer, agrees to pay all account balances, penalties, service charges, attorney’s fees, and court costs incurred in the collection of their past due account. Liability shall be joint and several. The undersigned further agree that any line of credit desired or approved is not a limitation of liability, and individually and on behalf of the Buyer, to be responsible for charges in excess of credit either desired or approved. This guarantee is a continuing guarantee of payment and shall ensure to the benefit of Archer Ready Mix Concrete LLC from the date heron and shall remain in full force and effect until written notice of termination thereof has been received by Archer Ready Mix LL by certified mail. Termination of the guaranty by the undersigned shall not affect any of the guarantor’s obligations hereunder with respect to indebtedness insured prior to termination. Buyer/Guarantor authorizes Archer Ready Mix Concrete LLC to investigate personal credit standing, financial circumstances and responsibility and instructs all persons having information concerning such credit standing, financial circumstances and responsibility to release such information to Archer Ready Mix Concrete LLC., its agents, attorneys, or employees. This includes, without limitation, authorization for Archer Ready Mix Concrete LLC and its agents, attorneys, or employees to request, obtain and use for all purposes which Archer Ready Mix Concrete LLC deem necessary, a copy of any credit bureau or consumer credit report for the Buyer/Guarantor at any time. The undersigned agrees that a photocopy or facsimile copy of its authorization shall be valid as the original.
